Marshall in 2026: the 2019 law went into force within hours of Dobbs. Alabama is still defending it.

In a March 19, 2026 commentary in 1819 News, Attorney General Steve Marshall wrote that when the Supreme Court overturned Roe v. Wade on June 24, 2022, “Alabama fully implemented the bill within hours of the decision.” That bill is the Human Life Protection Act, signed by Gov. Kay Ivey in 2019 as what he called “a near-total protection of life in the womb.”

He said he had spent nearly a decade as attorney general fighting for the unborn in courtrooms and briefs, and that Alabama “stands firmly with those fighting to restore common sense safeguards for women’s health and to protect the sovereignty of pro-life states.”

He argued that mail-order chemical abortion has been used to evade state limits. He wrote that he joined 21 other attorneys general on a friend-of-the-court brief supporting Louisiana’s challenge to the end of in-person dispensing. He asked the Trump administration to direct HHS to restore in-person prescribing and physician dispensing. He did not publish a list of sellers.

Alabama Political Reporter, on July 28, 2026, still described Alabama law the same way: abortions illegal in almost all cases since 2022, no rape or incest exceptions, legal only through limited exceptions where the pregnant person’s life is at risk or carrying to term would result in severe physical health impairments.
